These Terms of Service (“Terms”) govern your access to and use of kingheavyequipment.com (the “Site”), operated by King Heavy Equipment (“we,” “us,” or “our”). By using the Site or submitting a quote request, you agree to these Terms. If you do not agree, please do not use the Site.

1. About This Site

The Site provides information about our heavy-equipment rental services in Northeast Florida and Southeast Georgia and lets you request a quote. Content on the Site is for general information only and does not constitute a binding offer, a guarantee of availability, or professional advice.

2. Quote Requests Are Not a Rental Contract

Submitting the quote form does not reserve equipment or create a rental contract. It is a request for us to follow up. Any rental is subject to availability, our acceptance, identity and eligibility verification, and a separate written Rental Agreement signed at the time of rental. That Rental Agreement — covering payment, deposits, insurance, damage, operation, safety, and liability for the equipment — governs the rental and controls if it conflicts with anything on the Site.

3. Eligibility

You must be at least 18 years old and able to enter a binding agreement to use the Site or rent equipment. You agree that the information you provide is accurate and that you are authorized to provide any phone number or email you submit.

4. Communications Consent

By submitting your phone number or email, you agree that we may contact you about your request and our services by phone call, text message (SMS), and email using the details you provide, including by automated means where applicable. Message and data rates may apply, and message frequency varies. Consent is not a condition of renting from us. You can opt out of texts at any time by replying STOP, and you can ask us to stop calling or emailing by contacting us.

5. Pricing & Availability

Rates, rental periods, delivery fees, equipment specifications, and availability shown on the Site are estimates, may change without notice, and are not guaranteed until confirmed by us in writing. We make reasonable efforts to keep information accurate but are not liable for typographical errors, inaccuracies, or out-of-date information. The price and terms we confirm to you directly control.

6. Acceptable Use

You agree not to: use the Site for any unlawful purpose; submit false, spam, or another person’s information without permission; attempt to gain unauthorized access to the Site or its systems; interfere with the Site’s operation; or scrape, copy, or harvest content or data except as allowed by law.

7. Intellectual Property

The Site and its content — text, layout, graphics, logos, and photographs — are owned by King Heavy Equipment or its licensors and are protected by law. You may not reproduce or reuse them without our written permission. “John Deere,” “Bobcat,” “Caterpillar,” and other equipment names or marks are the property of their respective owners; we reference them only to describe the equipment we rent, and their use does not imply any affiliation with, sponsorship by, or endorsement from those owners.

8. Third-Party Links and Services

The Site may link to or embed third-party services (for example, Google Maps, Google Fonts, or our social pages). We do not control and are not responsible for those services, and your use of them is governed by their own terms and privacy policies.

9. Disclaimer of Warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. This section concerns the website only; the condition and use of rented equipment are governed by the Rental Agreement.

10. Limitation of Liability

To the fullest extent permitted by law, King Heavy Equipment and its owners and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of (or inability to use) the Site. Our total liability relating to the Site will not exceed one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless King Heavy Equipment from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. The “last updated” date above reflects the current version, and your continued use of the Site after changes means you accept them.
